Whitesnake Lose Hearing Law Suit

A couple who claim a Whitesnake show in 2003 caused them significant hearing loss have been awarded $40,000.
Blabbermouth report that Maryellen and Kevin Burns took out a law suit against the band, the venue (Orpheum Theater in Boston) and the promoter. Apparently, the pair’s original seats gave them a restricted view, so they were moved closer to the front, and the tower of speakers which, an expert said, was capable of blasting out a volume up to 22 times the acceptable limit for the human ear.







A couple sued Whitesnake for being too loud? Did they confuse bingo with rock’n'roll?

That couple are ridiculous!! what did they expect!! Its rock n roll, its supposed to be loud! They shouldnt of moved closer to the front should they.
bloody hell. you mean there are people who don’t realise rock concerts are loud? if you sit in front of a massive speaker what do you think will happen?
i’ve been to over 200 gigs and seen whitesnake 5 or 6 times and i can hear like coverdale can sing.
just goes to show you can sue someone for anything these days
as classic rock says “if its too loud,youre too old!”

Don’t believe that seeing one concert could do that. I saw Alice Cooper at Sheffield and the sound was almost at a painful level, and my hearing is still as good as Pete Townshends
Sadly its not loud enough for us when all the morons who think they are in the pub and want to shout at each other during the whole gig!
Seriously – print on the tickets a disclaimer – rock music is loud, might damage your health, just like they do on the back tickets for motor sport

“live to hear another gig” thats my motto!
I love rock and roll, but whats the point if you can’t hear it!
I’ve been regularly attending loud rock gigs since 1980 & yep, I have constant ringing in my left ear. Who’s fault is that? If you stand too close to a flame, there’s a good chance of being burned. That said, I saw Motorhead’s 30th anniversary gig in ‘05 at the Hammersmith & the volume that night was just fuckin’ stupid, especially as after 4 songs of industrial-level noise, Phil Campbell asked the audience if it was loud enough, & to my horror, everyone shouted ‘No!’, so up it went. (What else are you gonna shout at a Motorhead gig…?!). My already-bludgeoned-by-rock ears have never been the same since that night, & as pissed off as I am at the band & sound engineers for exposing us to a noise level akin to a fuckin’ fighter jet flyin’ over you at low level, I was attending a Motorhead gig by CHOICE and I should have known better than to go without any earplugs. Case closed.
Well, watch this space. This only the beginning, there’s probably a queue forming in the US as we speak. I’ll die laughing when someone sues Blackmores Night for the same reason!!!
This could be serious. It sets a precedent. Now all rock groups could be open to claims. How do you think that will effect touring bands (who are already struggling in these times)? Ticket prices will raise!
As usual, scumy solicitors are involved. No one is responsible for their own actions any more! Try to pass the buck onto someone else and sue them! F**k off P.C. Police (trying to feather your own nest), this is rock & roll!
Grasping, scavengers and to pick a Whitesnake concert for your disservice!. No little irony if you had chosen Motorhead to (de)fame. It would have been worthy of the notoriety/ PR spin, and your suit .BUT WS shame on you. I hope any Ill gotten gains bring unhappiness to your door and tinnitus to your hearing.

So we’ve already (supposedly) had the death of recorded music by morons and their illegal downloading, now I suspect we shall have the death of the live gig by this pair and their greed for the the “easy buck”. It’s about time this compensation culture was kicked in the gonads!

If you don’t like loud music, then go somewhere else or wear earplugs.
…Carlos – isnt there a disclaimer clause on concert tickets to cover promoters, venue or artists? – It needs to happen pronto. i.e. ‘All customers/patrons/audience members are instructed to wear ear protection during this and all music concerts. Promoter, Venue and Artist will not be liable for any subsequent hearing loss as a result of attending this performance. Every customer accepts full responsibility for the protection of their and/or childrens’ hearing….etc….’
There is no way this should have been awarded to the plantiff. Unfortunately, it could set a precident. cheers & good luck – J.
if they didn’t like loud music what the hell are they doin at a rock concert these tits will end up making bands turn down the volume so you cant hear it for fear of being sued is nothing sacred
This is ridiculous! Are they fuc**** idiots? It’s a ROCK concert not a carols singing… It is SUPPOSED to be LOUD. And c`mon for sure they’re not children so they KNEW that if they be closer it’ll be louder.. I think it’s even written on the ticket… I’m only 16, I was on over 40 concerts(form small clubs gigs like Venom, Saxon to sell out arenas like KISS, MOTLEY CRUE or AEROSMITH) and I still hear everything like I’m supposed to hear..
