Promoter Pulls Plug On Memories Of Woodstock Festival
This coming weekend’s Memories Of Woodstock festival has been cancelled, after only 1,000 tickets were sold for the event.
The three-day festival was to have been held on August 7-9 in Shrewsbury, in the Midlands, with Alvin Lee, Asia, John Lees’ Barclay James Harvest, Jefferson Starship and Jethro Tull among the artists billed to appear.
The festival’s official website says the reason for the cancellation is poor ticket sales.
The website of Midlands newspaper the Sunday Mercury reports that Brian Davies, of Memories Of Woodstock promoters New Dawn Events, recently revealed to them that only 1,000 tickets had been sold for the 15,000-capacity event.
The Memories Of Woodstock site also informs ticket holders that refunds will be given.
Here’s the festival organisers’ website statement in full:
“It is with huge regret that we have to notify that the Memories Of Woodstock event [is] now cancelled.
“The Memories Of Woodstock project was the brainchild of Mr Brian Davies who wanted to celebrate the 40 years anniversary of the best music festival in history. Unfortunately there are people in this world who do not share this vision.
“Rumours that had been put out and circulating regarding this festival were completly fabricated and scurrilous which resulted in poor ticket sales and eventually led to the cancelling of this great event.
“During the current economic climate we felt that we should give the public a festival that would give absolute value for money, however, it is obvious there are people out there who do not wish this to happen, but we will strive forward on a mission to give the public what they should always have, and that is… ‘Great music at a great price with no hidden extras.’
“A message to those wonderful music fans who bought tickets for these great events, once again contrary to rumour, refunds will be given.”
Of the bands and artists due to appear at Memories Of Woodstock, Jethro Tull leader Ian Anderson was sufficiently angered by the cancellation of the festival that he posted a furious missive on the Tull website. You can read it here.

Yup! Mister Anderson really gave that man a good talking to! Alvin Lee’s website said from the start that he would NOT be appearing, and the whole thing had a miff about it that said: “Nahhhh…..!” Shame on that wannabe promotor indeed!

this does not surprise me. it looked shaky from the start. the website was awkward to navigate and lacking in basic information. nik turner’s website ststed several weeks ago that the details for space ritual’s performance were incorrect. also the £3.95 postage for a ticket seemed excessive. maybe the sun has set on new dawn.
I think it was a mistake trying to market the festival on the back of the Woodstock name. That’s a lot to live up to – and I’m sure not all memories of Woodstock are particularly happy ones.

Real shame the event is not happening, especially for the thousand or so ticket holders, i as a seasoned festi, would recommend attending the cambridge rock festival this weekend ,especially as the organisrs there are offering special terms for ‘memories’ ticket holders

Gee, I’m shocked. Such a stellar lineup. Give me a break. There’s a reason they sold only a 1,000 tickets.
I actually got to speak to the promotor on the phone. He very politely stated that the top bands pulled out because of a legal loophole and that he would get on to sending me a refund. I’ts put me off buyin festival tickets on line…..I was nearly ripped off last year by the rocknblues festival being cancelled. It took weeks of slog to get a refund for that! I’m just hopin PayPal comes up trumps again. Wouldn’t care – we had considered the Cambridge Rock Festival first. Now I’m fighting for a refund of over £200 (again).

Gutted. Had just received the tickets, been looking forward to it for months. Was going to be my holiday this year. Now paid a fortune on camping gear and booked time off work and planned my 5-6 hour journey to Shrewsbury this weekend all for nothing and now can’t afford to go anywhere else. Sick as a chip!
This festival was never going to happen. The guy booked the venue in a well-known flood zone in a town which never had sufficient accomodation for the acts he pretended to book. He never had a hope of securing the advertised line-up and never entered into proper contracts with most of them. The promoter has to take the blame for advertizing a line up when 75% of the acts were never signed up. I spoke to the promoter in person and he told me I “must be sad” for wanting to see some of the acts he booked. Anyone with a ticket should phone Shrewsbury Police Station and ask for the fraud squad. This was a scam from the start adn Classic Rock mag should be ashamed of themselves for their involvement.
We booked our tickets back in April. PayPal won’t take any action (more than 45 days since transaction) unless there are a significant number of complaints. So those who used PayPal, please make sure you log the dispute. We are left with the choice of either waitng for a refund from Brian Davies or trying to recover from the credit card company we used to settle our PayPal account.
Shame we didn’t get a heads up about this much earlier from those in the know. Both Barclay James Harvest and Jethro Tull have offered to bring their weight in support of a refund which is good considering they (the artists) have been duped just as much as the paying public. Here’s Brian Davies’ mobile number: 07785 548218. Try it. Classic Rock mag knew there was something wrong with this deal MANY weeks before. As sponsors they were in the loop, and made the telling decision NOT to run the advert for the event in the August issue. That tells you these guys knew what was going on, and should take some responsibility.
I live in Shrewsbury and went to speak to the venue management. They had heard nothing from the promoter for several weeks before August, so he never intended to continue with the event from an early date. This needs to be fully investigated as a case of fraud.
Like many other I am concerned that this event has been cancelled. We got a letter saying refunds would be issued but so far nothing and Mr davies isn’t answering either of his phones nor is he replying via e mail …how do we track this guy down and get our money back?

I had a similar response from Mr Davies saying refunds were to be issued 15/16 august but so far nothing. We booked via paypal too but so far no luck with either. If he doesn’t want to pay Paypal charges then why not send people cheques ….i have no problem with format as long as he PAYS what is owed. Has anyone considered a claim against New Dawn by means of small claims court?
I’m certainly considering a CCJ quite soon – we will all need to do it if he doesn’t keep his promise. Will give him another week – I’m due over £330 refund and am getting frustrated, no response from e-mails! (Like a fool I paid him cash). Please, whoever gets a refund first, post info here.
Well I just heard back from Paypal who, despite adjudicating on my side and agreeing a refund is due, are unable to do so because there are NO FUNDS in the New Dawn Events account. I am seriously concerned about this now and will be reporting it as fraud.

Latest is that Mr D seems to be replying to my emails but only in the form of questions. i.e are u a paypal or credit card customer was the last response. I have specifically asked him to issue a cheque in refund as we paid by debit card. If he does not reply with a suitable respone by end of week we will seek to recover costs via CCJ. Hope others do the same but if in meantime he actually does refund anyone please could you let us know..cheers!
I have had no refund yet for the cancelled event at Crathes Castle. I have not heard from Mr Davies since August 2nd. I opened a dispute with paypal, but they have already closed the case.
Like everyone else I am getting frustrated by the lack of response from Brian Davies to my e-mails. I am about to send an e-mail to him now stating that if I haven’t received my money back, by the end of this week, then I will be commencing county court action against him.
I don’t suppose it will make any difference but I am prepared to give it a go.

When was the concert cancelled. I have a suspicion I was sold a ticket afterwards. I could be wrong but when was it?
According to Ian Anderson of Jethro Tull they were cancelled on Friday 31st August and the whole event was cancelled on 1st August. I found out about it via The New Dawn Events website on the 2nd.
I’m still waiting for £255 for tickets and hotel accomodation.Foolishly I paid by debit card over the phone to B.Davies.I spoke to Mr Davies over the phone several times & was told I would have a full refund by Aug.7th,when this didn’t happen I rang him threatening legal action & he put the phone down on me.I have since been unable to contact him & an email remains unanswered.I wil try once again to contact him in the morning & will be seeking legal advice.If anyone has any luck in the pursuit of the money owed can they share the details.

THE organiser of a cancelled Crathes Castle music event has promised a full refund to everyone who purchased tickets.
Several music fans contacted The Piper this week after failing to receive a refund for the three-day event due to take place from August 14-16 but was cancelled because of poor tickets sales.
One woman said that she had spent £123 for four ticADVERTISEMENT
kets and another had spent £119 but neither of them had been able to get in touch with the organisers New Dawn Events following the show’s postponement.
However Brian Davies of New Dawn Events said he was doing everything he could to ensure all refunds were issued within a fortnight.
He said: “The delay is because we have to wait for the insurance company to kick in. It takes time to settle the insurance before you can pay out – it unfortunately can’t be done instantly. What happened with the Michael Jackson concerts in London is a prime example.
“Everybody thinks it is easy to just send money back but it is actually a complicated process. A lot of the tickets were bought through PayPal so we have to send the money back to PayPal and then it is up to them to distribute that money back to those people who had bought tickets.
“Obviously there are different procedures to go through if people pay with different cards, cheques or cash. It is a bit of a nightmare to get through but hopefully we will get the money back to everyone as soon as possible.”
Mr Davies expects to lose £30,000 for having to postpone the three concerts. Former X-Factor favourite Jonathan Ansell, who shot to fame with pop opera group G4, was amongst the stars scheduled to perform.
However the show’s organisers decided to pull the plug on the event after only 140 tickets were sold for the opening day on Friday, August 14 and even fewer – 83 – for the proms night on August 16.
Despite the lack of tickets sales, New Dawn Events have vowed to return to Crathes Castle next year to stage another series of concerts.
Mr Davies explained: “It is such a beautiful venue – something has to happen there.”

Trading Standards Advice re Festival Refunds

We have received the following advice from Moray Council Trading Standards for those who have not yet received refunds from the cancelled “Memories Of Woodstock” festival in Shrewsbury:
Moray Council Trading Standards are aware that Brian Davies of New Dawn Events is based within Moray and that he sold tickets for music events in August 2009 which were subsequently cancelled by him.
Contact has been made with Mr Davies and at this point in time he has agreed to meet with officers from this department week commencing 7 September 2009.
We have received reports that members of the public have made payment for tickets for these events and are encountering problems when trying to obtain a refund of monies paid. This issue will be raised with Mr Davies at the proposed meeting.
In the meantime we would give the following advise for people seeking a refund.
1. Customers need to identify and contact the business who actually sold them the ticket as their contract is with that business.
2. Please write to this business stating the details of your complaint and that you are now seeking a refund and giving a reasonable time for the refund to be supplied (we suggest 14 working days). Include copies of any previous documents and appropriate Reference Numbers.
3. Keep a record of this letter and send it by registered / recorded delivery. Send it to the business address and any other known addresses for the business concerned.
4. If you have purchased your ticket(s) with a UK credit card and the total value of the tickets were over £100 then you should contact your Credit Card company, and indicate that if you are unsuccessful with your claim for a refund that you will be holding the credit card company equally liable for breach of contract.
Once the meeting has taken place or when we have any further information and advice, we will make further contact and where possible details will be forwarded to anyone who has made contact with this department about this matter.

As of this morning the cheque had not arrived. Have informed Trading Standards and will be taking action.
Heard today that the meeting with Trading Standards in Elgin has not taken place as Mr Davies could not attend as he has been taken to hospital with ‘broken ribs’!!!…….They still advise to write the letter for refund requests and send it Recorded Delivery and the meeting may be re-scheduled.
This is going to run and run – basically, we can not let him get away with this.

It is now nearly two months since you cancelled the Memories of Woodstock shows in Shrewsbury. In that time you have made no visible attempt to refund my ticket money (£172 paid by telephone on 16 May 2009 and £100 paid by credit card on 8 June 2009) or give me any explanation as to why you seem to think it’s ok to hang on to my hard-earned cash indefinitely. You appear to be unreachable by telephone so I am unable to contact you other than in writing.
I will say nothing about the two lots of £3.95 you charged me for a cheap envelope and a stamp. That, I will leave up to your conscience. (Hah!)
You have 14 days from receipt of this letter to refund my money in full or provide me with a genuine reason why this is not possible. After this I will act on the advice of my solicitor and initiate proceedings to the end of recovering my money.
I hope that will not become necessary and for the courtesy of a reply this time and a quick and satisfactory outcome

That was a fortnight ago and not so much as an acknowledgment. Haven’t heard of anyone getting even some of their money back Incidentally, the Touchdown Trials number never seems to get answered either. It’s obvious my letter had no effect at all, if indeed he bothered to open it, but it made me feel a bit better. This kind of behaviour is contemptible in the extreme and I hope it all comes back to bite him on the arse.

I bought two weekend tickets plus camping for this, thought the festival was too good to be true and so it turned out to be.
Once I found out about the cancelation I didnt piss about trying to contact Mr.davies, I claimed through my credit card providor and have been refunded. If you paid by credit card it might be worth contacting them.

So 1000 tickets. How much profit without cost do you think that is then? If you do not issue a refund and you do not issue a ticket it looks indistinguishable from fraud to me. Though, obviously, I’m no lawyer.

Regarding Grant’s 23 Nov posting above – I seem to be the only one Brian’s forgotten – presuming, of course, like the honest, upstanding citizen he is, he’s paid up.
I paid for 2 tickets for 2 days via Paypal. As I had about £20 already in my paypal account the balance of about £130.00 was deducted from my credit card. After sending a load of copy documents to the credit card company I was reimbursed the £130 a couple of weeks ago. I am going to approach Paypal for the balance for the third time next week. Their initial stance was that as I bought my tickets in March their 3 month deadline for reimbursement had passed. I contacted them again after the Watchdog programe and the lies about funds going into Paypal. They denied this had happened but I did tell them about the programe and they weren’t impressed that they had been mentioned in this way. This time they said that the situation may be revisited. Watch this space.
Still no refund here – we are going through Trading Standards and the courts now, the guy is a liar and has to go down for this.

My wife and I have been trying to recover the cost of our tickets bought for the Memories of Woodstock Festival back in April using a combination of PayPal and credit card.
The credit card company have reimbursed the element charged to them. However, getting any money out of PayPal has proved fruitless. Despite providing plenty of evidence in support of our claim, they refuse to refund the balance as the purchase was made more than 45(?) days prior to the request for reimbursement. As the concert wasn’t called off until the week before it was due to take place in August, that was impossible.
Communicating with PayPal can only be done by logging a complaint to which they will respond by means of a no reply email from Luxembourg. They will not enter into dialogue.
The latest response from PayPal states “Unfortunately, this case is currently in deferred status. Although we have a clause that deferred cases may be revisited within 180 days, there is no update yet if the case will be re-opened. Since we will not be able to guarantee if this payment lest the case will be reopened, personally, it is advisable to seek for other means of claiming this payment back”
So, despite the fact that organiser, Mr Davies, has gone on BBC’s Watchdog program and stated that he has made payment to PayPal so that ticket prices could be reimbursed, we are out of pocket. Either Mr Davies or PayPal are lying.
At 18:45 December 27th Mr Davies personally assured me he would be sending me a cheque for the full amount. Thats two clocks ticking now then…. the previous one started on the 24th November.
Still no sign of a refund.Awaiting update from trading standards.Living in hope that he’s had his Xmas ruined by the adverse weather conditions.

As of today: nothing. He is, if nothing else, consistent,as he has twice, personally, assured me that he would pay me within a week. As for the email he sent saying he would pay when his insurance appeared: thats 5 months ago now, so I suspect there is no insurance.

It does seem that some people are getting refunds at last. I received a cheque last week and it has cleared ok. 272 quid – still, he made nearly 8 quid out of me in ‘post and packing’ charges (one cheap envelope and a second class stamp for two separate orders sent together) so I imagine he’s done ok through these alone. On the Consumer Action Group thread there are entries from a coupl of peple who’ve had money back. I wonder what’s happening about the people who aren’t chasing him up – is he sending them out regardless because I had to email every day for a fortnight to get mine.

Problem is, I bought my tickets through a one-off Paypal transaction (i.e. I don’t have a Paypal account) – does anyone know whether it is still possible to send refunds back through these transactions? Or would I need to request a cheque?
I sent my emails through the New Dawn website link but kept hammering them off twice a day until I got a response. He paid me by cheque even though I’d paid by PayPal so I would mention that. The cheque cleared first time, no problems. Good luck – keep at him. I believe that if he has the money he will pay. Don’t think he’s so much a crook as an idiot although he obviously made a few quid out of the ‘postage ‘ charges

After hearing some people had been refunded I decided to have a stab at contacting Mr Davies.I spoke to him this morning at 11.15 regarding my refund & he ensured me I would have my money by the end of the month as would everyone else who is owed money.Hopefully the end of this matter is in sight but until I receive payment I wont hold my breath.This is the number I contacted him on 07785548218
End of February and (surprise, surprise) still nothing. Another broken promise.
This is absolutely criminal – if he thinks we’re just going to give up on this then he’s wrong. I’m just so furious that even Trading Standards / BBC Watchdog etc etc can’t do anything about it. Anyone else had any luck? Would Small Claims Court be a good route to take?
Still nothing here after endless promises both via e-mail and speaking personally. Yes, have bombarded him with e-mails but it’s made no difference. Pretty much at a loss on what to do now….roll on High Voltage!
I have spoken to the man on 3 occasions and on 3 occasions he has promised me a cheque would be sent.
Sell a service, take the money. Fail to provide the service. Fail to refund. Did I miss anything?
I still have his email telling me how when the insurance was paid I would be sent payment.
I am a NZer, and brought tickets very early on for my husband and I to see this show. It is now MAY 2010 and I have received no refund. Beyond pissed off. I payed through Paypal who of course won’t refund because I made a claim 45 days after purchase.

I emailed him in March on: brian.davies82@btinternet.com. I know that the email was delivered to the address but I didn’t receive a reply. I have telephoned him 3 times since then on the number given by Kev on 12th February and each time he has expressed surprise that I haven’t had my refund and has promsied to put a cheque in the post. Still waiting ……………………
I just thought I’d post to say I DID RECEIVE A REFUND by cheque, eventually. You need to keep at him, personally, by phone every day until he gets fed up. He has the money and will pay.

Here we are nearly a year from when he took our money and some of us are still not paid.
The word “thief” springs to mind. Cannot imagine why.
